1. Why didn’t you provide the mats your own safety videos say you must provide when I asked?
Probable Hershey Reply:
“We believe appropriate safety equipment was available and in compliance with company standards.
2. Why didn’t you comply with disability accommodation laws when you knew I had neuropathy?
Probable Hershey Reply:
“We evaluate accommodation requests individually and believe we followed required processes.”
3. Why didn’t you f-lile a proper injury report when I showed the wound?
Probable Hershey Reply:
“We followed our internal reporting procedures based on the information available at the time.”
4. Why didn’t you provide any medical treatment as the injury worsened?
Probable Hershey Reply:
“Employees are encouraged to seek medical attention through established channels.”
5. Why did you keep assigning me to the only station without mats when you had many other workers available?
Probable Hershey Reply:
“Work assignments are based on operational needs and available staffing.”
6. Why did you cheat workers on pay using a system that stole minutes every shift
Probable Hershey Reply:
“We are not aware of any timekeeping issues and believe our system is accurate and compliant.”
7. Why did you put me on a stand-up forklift when the goal was to relieve foot trauma?
Probable Hershey Reply:
“Job placements are determined by operational requirements and safety policies.”
8. Why does your
medical documentation blame my injury on the lack of mats — while that same document also claims the injury was not work-related?
(The contradiction.)

“We rely on independent medical providers, and we cannot comment on the opinions contained in their reports.”
9. Why did you mark my injury as “not work-related” when your own doctor wrote it was caused by standing without mats?
Probable Hershey Answer:
“Our records indicate the OSHA classification was entered based on standard internal guidelines.”
(Translation: a vague, scripted way of dodging the contradiction.)
